Terms of Service (TOS) for Wyldwood Bayou – An OpenSim Virtual World Grid
Effective date: October 28, 2020
This Terms of Service document and agreement thereof constitutes a legally binding contract between Wyldwood Bayou and the person(s) who use our services. Wyldwood Bayou is a private grid; no virtual land is available for sale and membership is by invitation only. Wyldwood Bayou is open for HyperGrid access.
All residents, members and visitors who use Wyldwood Bayou, its website and forums, virtual world and services must accept the terms of service and privacy policy below.
"us", "we", or "our", "WWB", "WWB Admin", "Wyldwood Bayou Grid" and "Wyldwood Bayou Virtual World Grid" are all pseudonyms of Wyldwood Bayou [WWB] who operates the wyldwoodbayou.com website and the Wyldwood Bayou Grid (the "Service").
We permit the use of your PayPal or Gloebit account on Wyldwood Bayou but are not responsible for any issues related to its use. Within Wyldwood Bayou, all virtual currency is considered game tokens of no real value.
Privacy
Wyldwood Bayou will collect only the minimum information necessary from residents and visitors. This could include avatar name, UUID and IP address information needed to enable your access to the grid or other similar data. No personal data other than an initial email address for members is captured, nor is the collected data linked to any personal information. Necessary cookies may be collected during web page log ins but do not reflect personal data other than avatar name and password. WWB will retain all information needed to maintain grid services for the amount of time it is required, which may be indefinitely.
Wyldwood Bayou does not permit the harassment or bullying of any visitor, resident, performer or staff member. This includes comments, hate speech or threats related to race, ethnicity, sexual orientation, avatar portrayal, age, religion or political stance. We reserve the right to remove and ban any person or group of persons who, in our judgement, indulge in this type of behavior. Partial or full banning is at the discretion of the grid administration.
People under the age of 18 are not permitted to have avatars in, or to visit Wyldwood Bayou
All public venues on Wyldwood Bayou are moderate content. No child avatars are permitted on Wyldwood Bayou. Child sexual roleplay is strictly prohibited and will result in immediate ban and account suspension of all involved. The grid administrators reserve the right to determine whether avatar age or behavior is appropriate.
Content within the Grid
We do not actively restrict, review, or monitor content that is brought into Wyldwood Bayou. WWB does not support the copying or permission modification of any creator's copyrighted content. However, it is impossible to check all items brought into or out of this grid and we are not responsible for any copied or modified content that does exist or may be imported in the future.
If you are a creator who believes your copyrighted content is used illegally on our grid, please contact a member of the Wyldwood Bayou Admin staff.
If there is a legitimate DMCA (Digital Millennium Copyright Act) order issued on any content within Wyldwood Bayou, we will comply with this by removing the listed content from all regions and from all avatars possessing it.

Wyldwood Bayou (WWB) Privacy Policy

We may also collect device information needed for support such as:
Operating system, hardware information, settings, file and software names and types, and device identifiers.
The geographical locations of the devices from which you're trying to access our Services.
Connection information such as the name of your ISP, browser type and time zone.
However, none of this information is linked to more than the email address supplied on member registration or the UUID for HyperGrid visitors. WWB cannot control what information may be captured by residents and/or visitors and stored on notecards while inworld. Chat logs and IM logs are stored locally on the user’s device and are not recorded. Offline IMs are held on the sever only until delivered and read.
WWB will retain all information needed to maintain grid services for the amount of time it is required, which may be indefinitely. Information not necessary for services is purged periodically.
WWB DMCA Policy

To file a DMCA request provide the following information:

Signature:The takedown notice should include the copyright owner’s signature or the signature of the person authorized to act on behalf of the owner (i.e., the owner’s agent). Contact Information:The takedown notice should contain the notice sender’s contact information. This information should include the notice sender’s email address. An address and/or telephone number may also be included.

Good Faith Belief:The takedown notice should include a statement that the notice sender has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Accuracy of your Statements:The takedown notice should include a statement that the information in the takedown notice is accurate, and under penalty of perjury, that the notice sender is authorized to act on behalf of the copyright owner. Providing false information and making a false claim is punishable under federal law, and those making false notices can be sued and held civilly liable.
